The MoPSW plans to develop a model concession agreement (MCA) for port projects that use the equip, operate and transfer (EOT), and operations and maintenance (O&M) models. The terms and conditions of a port contract are established by a concession agreement. So far, the ports under the central government have followed the MCA finalised by the ministry for build-operate-transfer (BOT) projects, which have a 30-year concession term. In November 2021, the ministry modified the MCA for BOT port projects to make the agreement more acceptable to bidders and bankable to lenders. In light of recent structural changes in the governance of state-owned ports, drafting a separate MCA for EOT and O&M contracts is important.
