Government notifies new guidelines to govern social media, digital news and OTT platforms

The Ministry of Electronics and Information Technology has notified the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 to govern the digital media industry, including social media platforms, digital news and over-the-top content platforms. The rules have been framed under the Information Technology Act, 2000, and will supersede the 2011 guidelines for internet intermediaries. The new rules make a distinction between social media platforms based on the number of users, which will determine whether an entity is a “social media intermediary”, or a “significant social media intermediary”. The latter will be required to follow additional due diligence.
